Access to and/or use of this SOM NIT HOTELS portal confers the status of USER, who accepts, from the moment of such access and/or use, the General Terms of Use set forth herein. These Terms shall apply regardless of any applicable General Terms and Conditions of Contract that may be mandatory for making reservations through our integrated booking engine.


3. USE OF THE PORTAL

www.somnithotels.com provides access to a multitude of information, services, programs or data (hereinafter, "the content") on the Internet belonging to CHECK-IN BORN, SL or its licensors.

The USER assumes responsibility for the use of the portal. This responsibility extends to any registration required to access certain services or content (such as managing reservations at our hotels and hostels). During registration, the USER is responsible for providing truthful and lawful information. As a result of this registration, the USER may be provided with a password for which they will be responsible, undertaking to use it diligently and confidentially.

The USER agrees to make appropriate use of the content and services that SOM NIT HOTELS offers through its portal and, by way of example but not limitation, not to use them for:

  • Engaging in illicit, illegal, or activities contrary to good faith and public order.

5. EXCLUSION OF WARRANTIES AND LIABILITY

SOM NIT HOTELS is not responsible, under any circumstances, for damages of any kind that may be caused, including but not limited to: errors or omissions in the content or texts, lack of availability of the portal or the transmission of viruses or malicious or harmful programs in the content, despite having adopted all the necessary technological measures to prevent it.

Furthermore, since the booking process is carried out through the integration of the Cloudbeds engine, SOM NIT HOTELS is not responsible for any technical interruptions that this external provider may suffer, although it will ensure proper communication with them to resolve any issues as soon as possible.

Regarding AI-optimized content, the company strives to provide accurate information, but is not responsible for minor discrepancies that may arise from automated processing of real-time availability or pricing data.


6. MODIFICATIONS

CHECK-IN BORN, SL reserves the right to make any modifications it deems appropriate to its website without prior notice, and may change, delete or add both the content and services provided through it, as well as the way in which these are presented or located on its website (including prices, room descriptions and services of the different hotels and hostels).

CHECK-IN BORN, SL will pursue any breach of these conditions, as well as any improper use of its portal, by exercising all civil and criminal actions that may correspond to it under the law.

11. APPLICABLE LAW AND JURISDICTION

The relationship between CHECK-IN BORN, SL and the USER will be governed by current Spanish legislation and any dispute will be submitted to the Courts and Tribunals of the city of Barcelona.
